Truth and Reconciliation Commissions

Finding

South Africa’s TRC offered conditional amnesty for full disclosure — amnesty for honesty, not for silence. The TRC heard testimony from approximately 21,000 victims and received 7,112 amnesty applications, granting 1,500 (Commission final report, 1998/2003). Adapted in Canada (2008-2015), Rwanda (Gacaca courts, 2001-2012), Colombia (2017-present). The structural choice: when prosecuting all offenders is impossible, truth becomes the price of freedom.

Pattern Mapping

Honesty — Honesty as the central transaction of transitional justice. Tell the full truth and avoid prosecution; lie and face it. In systemic atrocity, the truth itself — publicly stated, officially recorded — may be more valuable than individual punishment.

Alignment — Mechanism suited to actual conditions. Conventional criminal justice aligns purpose with mechanism for ordinary crime; the TRC adapted alignment for extraordinary circumstances.

Non-fabrication — Apartheid depended on fabrication: fabricated racial categories, fabricated justifications, fabricated narratives of benevolence. The TRC replaced the official lie with testified truth.
