Separation of Powers

Finding
Political liberty requires separating governmental power into legislative, executive, and judicial branches. When any two combine in the same hands, tyranny results. A legislature that also judges can punish enemies retroactively. An executive that also legislates can rule by decree. The French Declaration (Art. 16): “A society in which the separation of powers is not defined has no constitution at all.”
Pattern Mapping
Humility — No branch exercises authority beyond its legitimate scope. The legislature writes law but does not adjudicate. The executive enforces law but does not create it. The judiciary interprets law but does not legislate. Each branch’s authority is bounded, and the boundaries are enforced by the other branches.
Alignment — Governmental purpose and operation align only when power is distributed. Concentrated power creates structural incentive for the purpose to shift from public service to self-perpetuation.
Proportion — Checking mechanisms are themselves proportional: veto overridden by supermajority, judicial review cannot write new laws, impeachment reserved for high crimes.
